legal, professional and other costs incurred in preparing for and attending the

mediation.

Neither party shall commence legal proceedings until the negotiation and mediation

process has been concluded or one party has failed to participate in the process in

good faith.

Nothing in this clause shall prevent either party from seeking urgent interim or

injunctive relief where it is reasonably necessary to protect its legal rights or where a

limitation period or statutory time limit would otherwise expire.
